1. Acceptance of Terms

By accessing or using BOTIL (“the Service”), operated by Yitzhak Dahan, Israeli Authorized Dealer No. 314885518, located at HaPsanter 9, Rishon LeZion, Israel, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

BOTIL provides automation, integration, and management tools utilizing the WhatsApp Business API. We act as a technology provider facilitating communication between your business and your customers.

3. User Responsibilities and Meta Compliance

As a user of BOTIL, you are solely responsible for the content of the messages sent through our Service. You explicitly agree to:

• Comply with all applicable laws and regulations.
• Strictly adhere to the WhatsApp Business Messaging Policy and WhatsApp Commerce Policy.
• Obtain explicit opt-in consent from your customers before sending them automated messages.
• Refrain from sending spam, offensive, illegal, or unauthorized promotional content.

4. Account Suspension and Termination

We reserve the right to suspend or terminate your access to BOTIL immediately, without prior notice, if we determine that you have violated these Terms or any of Meta’s policies. If Meta suspends or bans your WhatsApp Business account due to policy violations, BOTIL bears no responsibility or liability.

5. Limitation of Liability

BOTIL provides the Service on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted or error-free. In no event shall BOTIL be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruptions, arising out of your use of the Service or any actions taken by Meta Platforms, Inc.

6. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after any such changes constitutes your consent to such changes.
